Dealing with Liens & Judgements



Remember in everything we do as credit consultant we must learn to attach procedures. This is the case for liens.

If a lien is lawful liens there must be a few factors:

  • They must be backed by a court order, or a judgment of a claim from a court of proper jurisdiction. Otherwise, the lien is hearsay.
  • Lawful liens also must be registered with the Secretary of State.

Most liens do not conform to the local rules of court, or are simply incomplete and invalid.

The best way to deal with them is to sue the person, company or agency that placed the invalid lien on you or your property.

An easier way is to sue the credit bureaus for having a faulty process in how they re-investigate public records (i.e. the use of a third party database). This can be done without contacting the original source who is furnishing the information to the public and other third parties.
